Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Effective date:
This notice applies to The Good Care Helpers, 5865 Ridgeway Center Pkwy, STE 300, Memphis, TN 38120. We are required by law to protect your health information, to follow this notice, and to tell you about your rights.
You can download or print this notice, and you can ask us for a paper copy at any time, free of charge, by calling 901-430-9186.
How we use and share your health information
For your treatment
We use your information to provide and coordinate your care, and we share it with others involved in treating you.
For example: our nurse shares notes about a wound with your treating physician, or tells your caregiver which medications you take and when.
To get paid for your care
We use and share your information to bill for the care we provide and to get paid.
For example: we send a claim and supporting records to the U.S. Department of Labor under the EEOICPA program, or to Medicare, Medicaid, or your insurance.
To run our agency
We use your information for the everyday business of running a home care agency.
For example: a supervisor reviews a caregiver's visit notes to check the quality of your care, or we use records to train staff.
Other situations where the law lets or requires us to share information
We may use or share your information without your written permission in the situations below. We only share what is needed.
To help with your care
- With family or friends involved in your care — if you are there and do not object, or if you are not able to tell us and we judge it to be in your best interest. For example, telling your daughter what time the caregiver is coming.
- With your personal representative — someone with legal authority to act for you.
- In a disaster — so relief organizations can tell your family where you are.
For public health and safety
- Public health activities — reporting disease, reactions to medication, or problems with a medical device.
- Abuse, neglect, or domestic violence — reporting as the law requires.
- Serious threats to health or safety — to prevent serious harm to you or someone else.
For legal and government purposes
- When the law requires it.
- Health oversight — audits, inspections, and licensing reviews.
- Lawsuits and legal actions — in response to a court order, subpoena, or similar.
- Law enforcement — in the limited circumstances the law allows.
- Workers' compensation programs, including federal programs such as EEOICPA.
- Specific government functions — such as military, national security, or protective services.
- The U.S. Department of Health and Human Services, if it is checking that we are following privacy law.
Other situations
- Medical examiners, coroners, and funeral directors, and about people who have died.
- Organ, eye, and tissue donation.
- Research, where an approval process protects your privacy, or where information has been stripped of anything identifying you.
- Our business associates — companies that do work for us, such as billing or software. They must agree in writing to protect your information.
- Workforce members who are victims of crimes.
- Scheduling and coordinating your care — we may contact you to arrange visits.
Things we will only do with your written permission
We will ask for your written permission before we:
- share psychotherapy notes, if any exist;
- use or share your information for marketing; or
- sell your information. We do not sell your information.
For anything else not described in this notice, we will ask your written permission first. You can change your mind and withdraw that permission at any time, in writing. Withdrawing it does not undo anything we already did while we had it.
Once information is shared, it may be shared again
When we share your information with someone outside our agency — for example a doctor's office or a government program — the law that protects it here may not apply to them. They may be allowed to share it again, and once that happens it may no longer be protected by this notice.
Reproductive health care information
Federal rules place extra limits on using or sharing information about reproductive health care. Under those rules we are prohibited from using or sharing your information to investigate or bring legal action against you, or against anyone who provided or helped you obtain lawful reproductive health care, simply because that care was sought or provided. If someone asks us for information that might relate to reproductive health care for one of those purposes, we must first obtain a signed statement from them confirming it will not be used that way before we release anything.
For example: if we received a request for records in order to investigate someone for obtaining lawful reproductive health care, we would refuse it.
Your rights
To use any of these rights, call us at 901-430-9186 or write to us at the address at the end of this notice. We will tell you if there is a form to complete.
Ask us to limit what we use or share
You can ask us not to use or share information for treatment, payment, or our operations. We are not required to agree, and we will say no if it would affect your care.
There is one request we must agree to: if you pay for a service completely out of your own pocket, you can tell us not to share information about that service with your health plan, and we will not — unless the law requires it.
Ask us to contact you in a certain way
You can ask us to contact you at a particular phone number or address, or by a particular method. We will say yes to all reasonable requests.
See and get a copy of your records
You can ask to look at or get a copy of your health and billing records. We will normally respond within 30 days. We may charge a reasonable, cost-based fee for copies.
Ask us to correct your records
If you believe something in your record is wrong or incomplete, you can ask us to correct it. We may say no, and if we do we will explain why in writing.
Get a list of who we shared your information with
You can ask for a list of the times we shared your health information, and who we shared it with. This does not include sharing for treatment, payment, our operations, or certain other situations.
Get a paper copy of this notice
You can ask for a paper copy at any time, even if you agreed to receive it electronically. We will give you one promptly, free of charge.
Our duties
- We are required by law to protect the privacy of your health information, to give you this notice of our legal duties and privacy practices, and to tell you if a breach happens that may have affected your information.
- We must follow the terms of the notice currently in effect.
- We reserve the right to change this notice, and to apply the changes to information we already hold as well as information we receive in future. If we make a material change, we will post the new notice on our website at thegoodcarehelpers.com, have copies available at our office, and give you a copy at your next visit or on request.
